If two submissions occur on the same account from two (2) or more agents, the first complete submission received will be the agent of record. For paper submissions, a complete submission means a completed Acord application with the company's federal ID number and currently valued loss runs. For online submissions, a complete submission means all information is filled out fully and accurately and submitted online.
If two (2) or more complete submissions are received in our office on the same day, we will telephone each agent and the first to present an agent of record letter will be honored as the servicing agent. If no letters are received, we will quote for all agents using the same pricing.
Agent of Record
In order to become the agent of record we must have a letter from the applicant on company letterhead, or the Acord 36 form, signed by an owner/officer indicating that they would like you to be the servicing agent. After we receive your letter, we will notify the current agent and allow him/her five (5) business days to obtain a letter from the applicant rescinding the agent of record letter. If we do not receive a rescinding letter, your agency will become the servicing agent. We will accept one rescinding letter only.
KESA accepts mid-term agent of record changes. If an AOR change occurs mid-term, commission will be paid to the original agent on any premium collected on the account prior to the AOR change. Commission will be paid to the new agent on any premium collected on the account from the effective date of the change forward. This includes any audit adjustments. Likewise, if an AOR change occurs at the policy renewal date, commission will be paid to the original agent on any premiums already received.
